Service Description: TheTripCuraçao operates an online marketplace where customers can browse and book services offered by independent third-party providers, including but not limited to tour operators and accommodation providers. TheTripCuraçao does not provide, own, manage, or control the services listed on the platform. TheTripCuraçao may modify, improve, suspend, or discontinue website features at its discretion without notice.
Marketplace Role & Liability Disclaimer
TheTripCuraçao operates exclusively as an online marketplace that connects customers with independent third-party service providers. TheTripCuraçao does not own, employ, manage, control, or operate any tours, activities, transportation services, or accommodations listed on the platform.
Third-party providers are solely responsible for the performance and delivery of their services, compliance with applicable laws and regulations, possession of required licenses and permits, maintaining appropriate insurance coverage, and ensuring safety standards.
All content on the platform, including descriptions, pricing, availability, schedules, inclusions, exclusions, and safety information, is provided by third-party providers. While TheTripCuraçao strives to present accurate and up-to-date information, we do not guarantee the completeness, reliability, or accuracy of such content.
By making a booking through our platform, you acknowledge and agree that TheTripCuraçao acts solely as an intermediary between you and the third-party provider. The contract for the service is concluded directly between the customer and the third-party provider, who is fully responsible for delivering the booked experience.
To the maximum extent permitted by law, TheTripCuraçao shall not be held liable for:
- Any inaccuracies or misrepresentations in third-party content
- Personal injury, accidents, illness, death, damages, loss, theft, or delays occurring during or as a result of a booked service
- Acts, errors, omissions, negligence, misconduct, or breach by any third-party provider
- Cancellations, changes, no-shows, weather disruptions, force majeure events, or service interruptions
- Disputes between customers and third-party providers
Any claims, complaints, refund requests, or legal matters arising from the service must be directed to the relevant third-party provider responsible for delivering the experience.
User/Customer: The user/customer is the individual who completes a booking via the platform. The person making the reservation confirms that they are authorized to act on behalf of all participants included in the booking and accepts these terms on their behalf.
Third Parties: Third-party providers are independent companies or individuals who offer services listed on TheTripCuraçao. They are not agents, employees, partners, or representatives of TheTripCuraçao.
Booking and Payment: All bookings must be made through our website. Full payment is required at the time of booking unless otherwise stated. We accept major credit cards and other secure online payment methods.
Cancellations & Refunds: Cancellation and refund policies are determined by each third-party provider and will be displayed during the booking process or in the booking confirmation. TheTripCuraçao does not determine refund eligibility and cannot guarantee refunds unless explicitly stated. Processing fees and transaction costs may be non-refundable.
Limitation of Liability: To the fullest extent permitted by applicable law, TheTripCuraçao’s total liability for any claim arising out of or relating to the use of the platform shall not exceed the amount paid by the customer to TheTripCuraçao for the specific booking giving rise to the claim.
Indemnification: By using this platform, you agree to indemnify, defend, and hold harmless TheTripCuraçao, its directors, employees, affiliates, and partners from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the platform, violation of these terms, or disputes with third-party providers.
Force Majeure: TheTripCuraçao shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, government actions, strikes, pandemics, transportation disruptions, or technical failures.
Governing Law & Jurisdiction: These terms and conditions shall be governed by and interpreted in accordance with the laws applicable in Curaçao. Any disputes arising from these terms shall be submitted to the competent courts of Curaçao.
Changes and Modifications: TheTripCuraçao reserves the right to change or modify these terms at any time. Updated versions will be posted on this page with immediate effect. Users are advised to review these terms periodically.
